To the maximum extent permitted by applicable law, in no event and under no legal theory shall Lilsta be liable to the User or any other person for any general, direct, indirect, special, incidental, consequential, cover or other damages of any character arising out of the use of or inability to use the Website or the services provided therein, including but not limited to, personal injury, loss of data, loss of profits, loss of assignments, data or output from the service being rendered inaccurate, failure of the Website service, server down time, damages for loss of goodwill, business interruption, computer failure or malfunction, or any and all other damages or losses of whatever nature, even if Lilsta has been informed of the possibility of such damages.

The Website might contain links to third-party sites. A User accesses such sites of his or her own volition, and Lilsta is not responsible for any engagement between the User and such third-party website or its owners.

 6.   Types of Information Collected; Uses of Collected Information

We collect two types of information about Users:

a)      Personal Information

“Personal Information” or “PI” is information that identifies a specific User. When a User engages in certain activities on the Website, such as creating an account, ordering a product or service from us, submitting content and/or posting content in discussion forums, providing information while participating in a survey, posting a review, requesting information about Lilsta’s services, applying for a job (collectively, “Identification Activities”], Lilsta may ask the User to provide Personal Information. The User always retains discretion to refuse to provide requested Personal Information. However, where such Personal Information is mandatory for completion of the transaction or activity that the User is engaged in, Lilsta may be constrained, and retains the right, to refuse to complete the activity or transaction. Lilsta may also share PI with service providers, or agents, deployed or engaged by Lilsta in the course of its business.

Lilsta uses PI to, inter alia, enhance the Website’s operations, for marketing and promotional efforts, analyze use of the Website, and improve Lilsta’s product offerings. Lilsta reserve the right to dislose PII if the law requires disclosure, or if validly demanded by lawful authority. 

b)     Generic Information:

Generic Information is information that does not identify a specific User. This type of information includes relevant browsing data of a User, such as the URL of websites visited before and after the User visited the Website, the type of browser used, and the User’s Internet Protocol (“IP”) address.

Generic Information does not ordinarily raise significant privacy issues. It is used in various ways. Apart from the uses to which PI are put, Generic Information is used for data analytics. Lilsta reserves the right to dislose Generic Information if the law requires disclosure, or if validly demanded by lawful authority or third party claiming that the User is acting in violation of its rights, subject to Lilsta being satisfied, at its discretion, that such claim is tenable or valid.

All Generic Information which involves processing of data, and constitutes a distinct “product” or “data-set” is the property of Lilsta, and a User shall have no claim whatsoever over the same. The User hereby expressly waives any such claim, whether available in law or in equity.

7.  Disclosure of PI

We respect privacy and do not share PI except in extraordinary circumstances.There are, however, certain circumstances in which Lilsta may be required to disclose information, including PII.

Specifically, and without limitation, Lilsta engages various third parties (“Third Party Service Providers”) to maintain the Website, promote the business, operate the Website and provide the services offered on the Website. Lilsta may disclose PI to a Third Party Service Provider for performing functions for which it is engaged. Third Party Service Providers will not use PI for any purposes other than those agreed by amongst Lilsta and the concerned Third Party Service Provider. Lilsta also ordinarily requires such Third Party Service Providers to implement systems to protect PI. Lilsta may also share or transfer PI held by it in the event of a corporate reorganization or restructuring whereby Lilsta’s business is transferred to another entity.

8.  Release of Generic Information

Lilsta may share Generic Information in, without limitation, the following circumstances:

a)      Lilsta may disclose or share Generic Information with Third Party Service Providers, partners, affiliates and advertisers.

b)     Lilsta may share aggregated demographic information (which does not include any Personal Information) with third party advertisers or third party advertising companies.

c)      Lilsta may use Third Party Service Providers to track and analyze Generic Information to administer and enhance the Website.

d)     Lista may publish Generic information for promotional purposes.

e)      Lilsta may also share or transfer Generic Information held by it in the event of a corporate reorganization or restructuring whereby Lilsta’s business is transferred to another entity.

Lilsta uses Cookies on, and in relation to, the Website in manners customary in contemporary e-commerce business including for customization of User experiences, time-optimization, identification of Users, and to track User interests. Cookies also allow Lilsta and the Website to collect Generic Information from Users. They may also be used in display of advertisements on the Website.  While certain parts of the Website may also contain Cookies placed by third-parties, Lilsta does not control, or accept responsibility for the same.

 Lilsta may also use various technologies to track a User’s activity on the Website, and allow Third Party Service Providers access to such technology, or to deploy such technology, and data generated from the same.  Such technology may permit us to determine a User’s actions, including whether or not he or she has acted in a particular manner. The data generated is, however, ordinarily Generic Information.

 11.  Security of Information

 Lilsta is committed to protecting Users’ Personal Information take appropriate precautions to protect the security of PI. All PI is stored securely and Lilsta restricts access to such information. Lilsta may also deploy appropriate encryption software, as deemed necessary, to protect PI.

Transmission of Data over the internet, however, involves inherent security risks, which are not capable of elimination in entirety. These risks are not specific to Lilsta or the Website but are universal in all e-commerce transactions. Users engaging in activity on the Website hereby confirm that they bear all such risks of any nature whatsoever. Lilsta cannot and does not warrant or guarantee the security of information.

 12.  Miscellaneous Privacy Issues

Children. Minors under the age of 18 are not supposed to use the Website. We do not collect or maintain information from anyone known to be under the age of 18, and no part of the Website is designed to attract anyone under the age of 18. Parents and guardians should supervise minors’ use of the Website, and Lilsta disclaims all responsibility from such use.

User Interactions. The Website might contain virtual spaces where Users may share information with other users or post public statements. While Lilsta will, so far as possible, endeavour to ensure that decency is maintained, Lilsta is not responsible for data or statements in such virtual public spaces.
